Terms of Use

These Terms of Use (hereinafter "Terms") govern access to and use of the Whalli platform (hereinafter "the Platform"), accessible at whalli.com, published by Whalli, 19 mail Haroun Tazieff, 44300 Nantes, France.

Any use of the Platform constitutes full acceptance of these Terms.

Access to the Platform is restricted to adults (16 years or older) or to legal representatives of legal entities.

Users agree to provide accurate information when creating their account and to keep it up to date. They are solely responsible for the confidentiality of their login credentials.

Whalli reserves the right to suspend or delete any account used fraudulently or in violation of these Terms.

Whalli is a multi-model AI platform offering, among other things:

• Chat with language models (LLM) from multiple providers;
• Image, video and music generation;
• Audio transcription and text-to-speech synthesis;
• AI workflow creation (Flows) and automations;
• Custom workspace configuration (Whales);
• AI model competitions (Arena).

Use of the services is subject to a credit system. Credits are consumed based on the model used and the complexity of the request.

Users subscribe to a monthly or annual plan that includes a monthly credit allowance. Additional credits can be purchased separately under the conditions set out on the Pricing page.

Unused credits may be carried over from month to month according to the subscribed plan.

Users agree to:

• Use the Platform in compliance with applicable laws and regulations;
• Not generate unlawful, defamatory, obscene, racist, hateful, violent content or content that violates the privacy of third parties;
• Not attempt to circumvent security measures or technical limits;
• Not resell, rent or sub-license access to the Platform to third parties;
• Not use the Platform to train or improve competing AI models.

Whalli retains all intellectual property rights over the Platform, its source code, interfaces and trademarks.

AI-generated content produced at the user's request belongs to the user, within the limits of the terms of use of the third-party models used. Whalli claims no rights over outputs generated on behalf of users.

The Platform is provided "as is". Whalli does not guarantee that the service will be uninterrupted, error-free or free of defects.

Whalli cannot be held liable for content generated by third-party AI models, nor for indirect damages arising from use of the Platform.

In any event, Whalli's liability shall not exceed the amounts actually paid by the user in the three (3) months prior to the triggering event.

Users may delete their account at any time from their account settings. Termination takes effect at the end of the current subscription period.

Whalli reserves the right to terminate or suspend an account without notice in the event of a breach of these Terms.

Whalli reserves the right to amend these Terms at any time. Changes take effect upon publication on the website. In the event of material changes, users will be notified by email.

Continued use of the Platform after notification constitutes acceptance of the new terms.

These Terms are governed by French law. In the event of a dispute not resolved amicably, the courts of Nantes shall have sole jurisdiction.
